Abstract

Cuida-se, não apresentar presente, analisar o disposto no § 2º do artigo 142 da Lei nº 8.112 / 90, ou qual estabelecido que “Os prazos de prescrição prescritos na lei penal aplicam-se às infra-estruturas disciplinares também como crime” , e das consequências recomendadas pela utilização dos prazos prescritos previstos nos incisos I, II e III, artigo combinado com uma regra do artigo 170 do mesmo diploma legal, segundo a qual “Extinta a punibilidade pela prescrição, a autoridade julgada determinada ou registro do fato nos assentamentos individuais do servidor ”.
