Utilização de pregão nas contratações de obras e serviços de engenharia

Abstract

O presente trabalho analisa a viabilidade da aplicação da modalidade de licitação pré-contratada nas obras e serviços de engenharia, tendo em vista os posicionamentos divergentes sobre uma matéria. Discorre sobre as características do pregão presencial e eletrônico, como vantagens recomendadas pela sua utilização pela Administração, com mensuração dos benefícios econômicos no governo federal durante o exercício de 2008, sobre quais bens e serviços podem ser considerados comuns, e enfatiza a argumentação contrária e também favorável à sua utilização em obras e serviços de engenharia, à luz da legislação vigente, da doutrina pertinente e da jurisprudência mais abusiva.
