Abstract

O poder disciplinar é um dever de poder, ou seja, não pode ser o administrador público, sob pena de ser ele mesmo punido, tergiversar sobre a apuração de faltas praticadas pelos seus subordinados. Isso não implica que uma disciplina disciplinar deva sempre implicada na instauração de processos administrativos disciplinares. O administrador público possui recursos escassos e deve utilizar as maneiras mais eficientes possíveis. Além disso, tanto a lei que rege os servidores públicos da União, como as diversas normas regulamentadas, os procedimentos diferenciados, os acordos com a complexidade da situação. Dessa forma, um fim de atendimento aos princípios de proporcionalidade e eficiência, deve o gestor público escolher o procedimento que mais se adequa à gravidade da situação tratada.
