A regulação baseada em dados: a era digital na agência reguladora de São Paulo

This article will present the experience of the Technical Director of Basic Sanitation of the Public Service Agency of the State of São Paulo – Arsesp in its paths to modernize regulatory activities. The path is structured on three fronts: the creation of a data warehouse that unifies its various databases; the standardization of the flow of data between the regulated and the regulator, promoting the standardization of formats and means of sending; the creation of a group dedicated to data analysis for activities to support the elaboration of normative acts and the training of civil servants in data analysis techniques and the use of specific software. Four years after these actions began, the initial results show the solidity of the path: adoption of alternative regulatory methodologies, such as menu regulation and Sunshine regulation, based on consumption of large databases; elaboration of normative acts strongly based on data analysis, resulting in a reduction of conflicts with the regulated; application of auditing techniques in databases, inducing the regulated to correct and update their sources of information and, finally, to reduce the asymmetry of information between the regulator and the regulated, expanding the regulatory perception of the problems faced and possible solutions.
