Slow and uneven progress: transparency and the implementation of Brazil’s Access to Information Law in the municipalities of the Recôncavo Region (Bahia)

Brazil’s Access to Information Law — LAI (Law No. 12,527/2011) was enacted as a key instrument to advance government transparency and the public’s right to information. This article reports findings from a study that sought to identify implementation challenges of the LAI across the 19 municipalities of the Recôncavo Territory in the state of Bahia. The analysis examined (i) local regulation of the LAI and (ii) levels of proactive (active) and reactive (passive) transparency, taking municipal population size into account. Data collection drew on the 2019 Brazilian Institute of Geography and Statistics’ Municipal Basic Information Survey (MUNIC 2019), a round that included items on LAI regulation. This was complemented by a systematic review of the official websites of the 19 municipal governments and by the submission of information requests via municipal electronic citizen information systems (e-SIC) to assess proactive and reactive transparency. Results indicate that the Recôncavo Territory performs better in proactive than in reactive transparency. Although proactive transparency appears more consolidated overall, several municipalities exhibited very low performance — below 10%. With respect to reactive transparency, performance was weak: only two municipalities responded to at least one information request. While local LAI regulation expanded over time, municipal adherence and compliance with legal requirements remain limited and slow, more than a decade after the law’s enactment. The identified challenges were organized into four dimensions: regulatory, managerial, civil service capacity, and technological constraints. Notably, observed transparency levels were not associated with municipal size, suggesting the need for further research on variations in municipal state capacity. In the Recôncavo, small municipalities — despite their more limited own-source revenue base — are not necessarily those facing the greatest difficulties in regulating and implementing the LAI.
